WHY the Apple Watch Has Been Banned?

In a significant development, Apple is set to face disruptions in the availability of its latest Apple Watch models in the United States. The groundbreaking step to remove a highly popular product from shelves is a direct result of a recent ruling by the International Trade Commission (ITC). The ITC found Apple in violation of a pulse oximeter patent held by medical company Masimo, which utilizes light to measure blood-oxygen levels. Apple incorporated this technology into its Apple Watch Series 6 lineup in 2020.

Which specific Apple Watch models are affected by the ban?

Commencing Thursday on Apple.com and from retail locations after December 24, Apple will cease the sale of its Apple Watch Series 9 and Apple Watch Ultra 2 in the United States. While other models are currently still available for purchase, the approval of an import ban could make them equally difficult to obtain. This potential ban encompasses the Apple Watch Series 6 and subsequent versions, as well as all models of the Apple Watch Ultra. Notably, sales of the Apple Watch SE will remain unaffected, according to Apple. Some retailers, including Best Buy, have indicated their intention to continue selling these devices.

Apple’s decision to withdraw one of its flagship products from the market is a response to an ongoing legal dispute with Masimo over the blood oxygen feature. Apple has consistently promoted its smartwatch as a life-saving device, contributing to its global popularity. However, the clash with Masimo poses a threat to this narrative.

Approximately two months ago, the ITC determined that several Apple Watches infringed on Masimo’s pulse oximeter patents, triggering a review period. During this time, Apple has the option to negotiate a licensing agreement with Masimo or appeal to challenge the ban. Masimo CEO Joe Kiani has disclosed that Apple has not yet approached the company for such an agreement or settlement, but he remains open to both possibilities.

Involvement of President Biden

The ITC’s ruling is currently under review by President Biden, who has a 60-day window to make a decision before a potential ban takes effect. This isn’t the first instance of a president becoming involved in a patent dispute concerning Apple, highlighting the significant implications of the case.
